Terms and Conditions

  1. This Privacy Statement describes how Ampol Australia Petroleum Pty Ltd (ABN 17 000 032 128) and its related bodies corporate ( referred to as “we”, “our”, “Ampol” or “Ampol Group”) collect, use and disclose Personal Information about individuals associated with the application for AmpolCard Facility or Bulk Facility, which includes a related application for credit (referred to as “you” in this Privacy Statement).

     

  2. In this Privacy Statement, "personal information" means information or an opinion relating to an identified individual, or an individual who is reasonably identifiable and includes credit-related personal information, such as your financial circumstances, credit worthiness, credit history, credit standing and credit capacity. 

     

  3. Ampol collects your personal information as part of the application for AmpolCard Facility or Bulk Facility (“Facility Application”) for the purposes of:
    1. assessing the Facility Application, including the associated credit application;
    2. processing and approving the Facility Application;
    3. creating your account with Ampol; and
    4. the ongoing management of your account with Ampol;
    5. supplying our products and services to you, supporting our related business activities and responding to your queries;
    6. marketing of Ampol Group products and services to you; and
    7. other purposes set out in Ampol’s Privacy Policy.
  4. If Ampol cannot collect personal information required as part of the Facility Application, or if the information is inaccurate or incomplete, we may be unable to process the Facility Application.

     

  5. If you provide personal information about another person to Ampol in connection with the Facility Application (such as a nominated user of an AmpolCard), you will need to obtain consent to share such information with Ampol from that person and notify them of Ampol’sPrivacy Policy.

     

  6. Our Privacy Policy contains further information about how we handle your personal information, including about:
    1. third parties that we may disclose your personal information to, which include third party service providers (e.g. technology service providers, companies that assist with Ampol’s marketing activities, and others) and credit reporting bodies;
    2. how Ampol and credit reporting bodies may deal with your Personal Information; and
    3. your rights to request your personal information be dealt with in particular ways.

     

  7. By submitting the Facility Application, you agree to Ampol processing your personal information in accordance with this Privacy Statement and our Privacy Policy. Without limitation, you agree that Ampol may:
    1. disclose personal information to other members of Ampol Group and third parties engaged to provide services to Ampol;
    2. obtain credit reports, including consumer credit reports, about you from credit reporting bodies to assess your application for commercial credit or to collect overdue payments from you;
    3. obtain and verify personal information about you from a motor vehicle, land title registry or a similar Government authority or from a business that provides commercial credit worthiness information;
    4. provide to and collect your personal information from any person whose details you disclose to Ampol in connection with the Facility Application;
    5. provide your personal information to Ampol’s collection agents if you default on your payment obligations. Credit collection agents will disclose information, including personal information, pertaining to the collection activities to Ampol;
    6. disclose your personal information to credit reporting bodies before, during or after providing credit to your business. This includes, but is not limited to: 
      1. identity particulars - name, gender, address (and the previous two addresses), date of birth, employer details and drivers licence number;
      2. the fact that you have applied for credit, the credit limit/amount, and that Ampol is a credit provider to you;
      3. advice about payments at least 60 days overdue and which are in collection (and advice that payments are no longer overdue or in collection);
      4. advice that cheque(s) drawn by you which are more than $100 has been dishonoured;
      5. the fact that you have committed a serious credit infringement; and
      6. the fact that credit provided to you has been discharged.
    7. exchange your Personal Information with another credit provider who may be named in your Facility Application or in a credit report issued by a credit reporting body or who proposes to provide credit to you or has provided credit to you. This is for purposes that may include, but are not limited to: 
      1. assessing your credit worthiness, your Facility Application and any subsequent application by you for commercial credit;
      2. assisting you to avoid defaulting in your credit obligations;
      3. assessing your financial position if you fall into arrears;
      4. notifying other credit providers of your default;
      5. exchanging information about your credit obligations with other credit providers; and
      6. administering your credit facility with Ampol.

     

  8. You also agree that Ampol may:
    1. use your personal information across Ampol Group for the purposes of marketing of our products and services by various means, such as direct marketing communications (via emails and SMS) or tailored advertising (on websites you visit, through our mobile applications or social media platforms). We may also contact you about products and services offered by our partners. If you do not wish to receive marketing communications from us, you can opt-out by contacting Ampol’s Privacy Compliance Officer at the details below;
    2. monitor and record your telephone conversations with Ampol’s team members for training, record keeping and service quality control purposes; and
    3. provide your personal information, as reasonably necessary, to a likely or actual buyer of the whole or part of Ampol’s business.
